You must be at least 18 years old and have the legal capacity to enter into binding contracts to use MatchSoles. By using our platform, you represent and warrant that you meet these requirements. If you are using the platform on behalf of a business, you represent that you have the authority to bind that business to these Terms. Individual sellers are welcome and do not need to represent a registered business.

You may not use MatchSoles to:

• List or sell counterfeit, stolen, or illegal products
• Engage in fraudulent activities or misrepresent products
• Harass, abuse, or harm other users
• Violate intellectual property rights
• Attempt to circumvent platform fees or policies
• Use automated systems to access the platform without permission
• Interfere with or disrupt the platform's functionality
• Collect user information without consent
• Engage in price manipulation or anti-competitive behavior
• Create fake reviews or ratings
• Conduct transactions outside the platform to avoid fees

MatchSoles charges commission fees on completed sales:

• 10% commission for new and like-new condition items
• 8% commission for good, fair, and poor condition items

All fees are clearly displayed before you list a product. Payment processing is handled securely through Stripe. Payment processing fees (charged by Stripe) are separate from platform commissions.

Fee Changes: We reserve the right to modify our fee structure with 30 days' notice to sellers.

Sellers are solely responsible for determining, collecting, remitting, and reporting any applicable sales tax, use tax, VAT, or other transactional taxes related to their sales on MatchSoles. MatchSoles does not calculate, collect, or remit sales tax on behalf of sellers. Sellers should consult with a tax professional to ensure compliance with all applicable tax laws in their jurisdiction.

All sellers must provide tracking information for every shipment. This is mandatory for:

• Buyer transparency and trust
• Dispute resolution and proof of delivery
• Platform protection against fraud
• Automatic delivery confirmation

Failure to provide tracking information may result in:

• Order cancellation
• Account suspension or termination
• Withholding of seller payouts
• Liability for "item not received" claims

Risk of Loss: The risk of loss or damage to an item passes to the buyer once the package is delivered to the shipping carrier. MatchSoles is not responsible for items lost or damaged in transit after the seller has provided the package to the carrier with valid tracking. Buyers should file claims with the carrier for lost or damaged packages, and sellers must assist buyers in resolving such claims.

While MatchSoles facilitates transactions between buyers and sellers, we are not a party to these transactions. However, we may assist in resolving disputes through our support team.

The MatchSoles platform, including its design, features, and content (excluding user-generated content), is owned by MatchSoles and protected by copyright, trademark, and other intellectual property laws.

User Content: By posting content on MatchSoles (listings, reviews, messages), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content on our platform.

You retain all rights to your content and are responsible for ensuring you have the necessary rights to post it.

MatchSoles provides the platform "as is" without warranties of any kind, either express or implied. We are not liable for:

• Product quality, authenticity, or accuracy of listings
• Seller or buyer conduct or performance
• Loss of profits or business opportunities
• Indirect, incidental, or consequential damages
• Delays, failures, or errors in platform operation
• Unauthorized access to your account or data
• Actions or omissions of third-party service providers

Maximum Liability: Our total liability for any claims arising from your use of MatchSoles shall not exceed the fees paid by you to MatchSoles in the past 12 months, or $100, whichever is greater.

You agree to indemnify, defend, and hold harmless MatchSoles, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any rights of another party
• Content you post on the platform
• Products you list or purchase

MatchSoles shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the Terms, and the remaining provisions shall remain in full force and effect.

We may update these Terms of Use from time to time. We will notify you of any material changes by posting the new terms on this page and updating the "Last Updated" date. For significant changes affecting your rights or obligations, we may also send you an email notification or require you to re-accept the terms. Your continued use of the platform after such changes constitutes your acceptance of the new terms.

These Terms of Use, together with our Privacy Policy and any other legal notices published on the platform, constitute the entire agreement between you and MatchSoles regarding your use of the platform and supersede all prior agreements and understandings.
